1. Validity and scope of the conditions of sale

1.1. These Terms and Conditions of Sale apply to the rights and obligations arising between Cutrico e-shop customers (hereinafter referred to as the Buyer) and Cutrico Hair OÜ (hereinafter referred to as Cutrico) when purchasing goods (hereinafter referred to as the Product/Products).
1.2. In addition to these Terms and Conditions, legal relations arising from the purchase of Products from Cutrico e-shop shall be governed by the laws in force in the Republic of Estonia.
1.3. Cutrico reserves the right to make changes to the terms and conditions of sale and sale prices, and these changes will be reflected on the Cutrico website www.cutrico.ee.
1.4. The terms and conditions of the sale to the business customer are agreed in the Sales Purchase Agreement.

2. Prices

2.1. All prices in the Cutrico e-shop include 20% VAT.
2.2. The discount percentages shown are rounded to the nearest whole number.

3. Placing orders

3.1. If this is your first time in the Cutrico e-shop, register as a customer. Fill in the required fields. Please fill in the fields carefully, as the accuracy and correctness of the information provided will determine the prompt and smooth delivery of the products purchased and the subsequent resolution of disputes and claims. If you’re already a customer, sign in.
3.2. In the Cutrico e-shop, you can buy products that have an “Add to cart” button. You must add them to your shopping cart to order the appropriate product.
3.3. Products intended for professional use can only be purchased by Cutrico approved beauty professionals.
3.4. Product prices and availability are subject to change without notice.
3.4.1. The price of the products is shown on the Product page, and in the case of a promotional price, both the promotional price and the regular price are reflected.
3.5. Buyers can view the contents of their shopping cart by clicking on the “Shopping Cart” icon at the top of the page.
3.5.1. The quantity of Products in the shopping cart can be changed by entering the desired number of Products in the quantity field.
3.5.2. Products can be removed from the shopping cart by clicking on the cross in the same row.
3.6. Click on the “pay” button to place your order.
3.7. Before confirming your order, fill in the required fields and select the appropriate delivery and payment method.
3.8. To confirm your order, click on the “Submit order” button.

4. Entry into force of the sales contract

4.1. The buyer will be bound to the order and the payment after clicking on the “Place order” button.
4.2. A prepayment invoice will then be drawn up, which you can pay immediately by credit card, bank transfer or bank transfer. The payment intermediary for the Cutrico e-shop is Montonio Finance OÜ. Cutrico Hair OÜ is the controller of the personal data, Cutrico Hair OÜ transfers the personal data necessary for the execution of payments to the processor Montonio Finance OÜ.
4.3. The sales contract is deemed to be concluded from the date of receipt of the amount of the advance payment to the bank account of Cutrico Hair OÜ after the confirmation of the order.
4.4. The order confirmation and a copy of the invoice will be sent to the e-mail address provided by the customer. Products will be posted by Cutrico after payment of the invoice. Orders placed in the Cutrico e-shop will be processed on working days Mon-Fri 09:00-17:00.

5. Delivery and delivery of products

5.1 Orders are delivered by Omniva parcel machines or courier. You also have the option of picking up the parcel at our representative store, in which case no delivery costs will be added to the order. Parcels will be dispensed during the shop’s opening hours Mon-Fri 9:00-17:00.
5.2 In the event that for any reason the Shipment is delayed, Cutrico will agree with the Buyer a suitable delivery time.
5.3 All orders placed on weekdays Mon-Fri before 14.00 will be delivered within 48 hours from the date of sending the order confirmation to Your e-mail address.
If the order is placed on a weekend or public holiday, the 48-hour time limit starts to run at 9.00 on the first working day following the weekend or public holiday.
5.3.1. You can pick up your parcel from a parcel machine 24 hours a day, day or night. The parcel can be picked up with a personal door code, which Omniva will send you by SMS or e-mail. When you enter the door code, the door of the locker where your parcel is located will open. If you don’t pick up your parcel from the parcel machine within seven days, it will be returned to us.
5.3.2. The courier will call you in advance to arrange a convenient day and time for delivery. For business customers, a courier will deliver the parcel within the working day without calling in advance. The order will only be delivered to the purchaser of the products specified in the order upon presentation of an identity document. The transfer of products to third parties is subject to the agreement of the buyer. If the courier is unable to contact you by phone, he or she will take the goods back to the post office and inform you by e-mail. If you do not pick up your goods at the post office within these days, you will have to pay the cost of returning the goods.

6. Right of withdrawal

6.1. Products purchased from the Cutrico e-shop are subject to a 14-day right of return from the date of receipt. If the Product ordered from the e-shop is not suitable for the Buyer, the Buyer may return it without giving reasons.
6.1.1. The withdrawal period shall expire 14 days after the day on which the Buyer or a third person other than the carrier and appointed by the Buyer has taken physical possession of the Goods.
6.2. No right of withdrawal:
6.2.1. goods which, by their very nature, cannot be returned and which have been delivered in closed packaging, but which have been opened by the customer;
6.2.2 goods which, once opened, would not be suitable for return for health or hygiene reasons;
6.2.3 goods for which Cutrico is unable to identify the unopening of the packaging or the non-use of the goods (e.g. the goods have no film around the cap);
6.2.4 to a product which has been mixed or combined with another product or good in such a way that they can no longer be separated;
6.3. In the event of return of the Goods, Cutrico will refund the Buyer the value of the Goods to be returned without undue delay, but no later than 14 days from the day Cutrico becomes aware of the Buyer’s decision to return the Goods. Contact Cutrico to return the product.
6.3.1. The cost of returning the goods is borne by the buyer, unless the reason for returning the goods is that they do not correspond to what was ordered (e.g. they are wrong or defective).
6.4. The Buyer must return the Goods to Cutrico without undue delay, but no later than 14 days after the day on which the Buyer notifies Cutrico of its wish to return the Goods. The product can be returned to the Cutrico store in Tallinn, Staapli 12-12.
6.5. Cutrico has the right to refuse to make any refund until Cutrico has received the returned Product or the Buyer has provided Cutrico with evidence that it has returned the Product, whichever occurs first.

7. Liability and complaints procedure

7.1 Cutrico shall be liable for any non-conformity or defects in the Goods sold to the Customer which become apparent within a period of up to two years from the date of delivery of the Goods to the Customer. In the event of a defect, the Customer has the right to contact Cutrico within two months at the latest, presenting the invoice on the basis of which the purchase was paid for. Cutrico shall not be liable for any defects in the Product caused by the Customer as a result of improper storage or use of the Product for a purpose other than that for which it was intended. In case of non-compliance or defects of the product, please send a complaint to tellimine@cutrico.ee.
The claim must state:
1) Customer name and contact details;
2) The date of the complaint;
3) A precise description of the non-conformity or defect.
4) Claim against Cutrico;
All complaints will be reviewed within 14 days of receipt and the Customer will be contacted as soon as possible.

8. Unquantifiable force

8.1. Cutrico shall not be liable for any damage or delay in delivery of the Product if the damage or delay in delivery of the Product is due to circumstances beyond Cutrico’s control or foreseeable.

9. Protection and security of personal data

9.1 The information and personal data collected during the newsletter and ordering process of Cutrico e-shop will be treated as confidential and will not be disclosed to third parties. Encrypted data communication with banks when paying for purchases ensures the security of the Customer’s personal banking details.

10. Other conditions

10.1. Product images are for illustrative purposes only.
10.2. Product prices and availability are subject to change without notice. In this case, Cutrico reserves the right to withdraw from the sale and to return the money to the Buyer’s bank account within a reasonable period of time.
10.3. Product information is regularly checked and improved. The information may have been updated since the Buyer’s last visit.
